Two Men Plead Not Guilty to Assaulting Police Officer in Kuantan

Date:

Two men pleaded not guilty at the Kuantan Magistrate’s Court on Monday to charges of causing injury to a police officer while on duty earlier this month.

The accused, 21-year-olds Muhammad Syarif Zawahid and Muhammad Syafiq Farhan Mohd Norizam, entered their pleas before Magistrate Tengku Eliana Tuan Kamaruzaman after the charges were read out.

According to the charge sheet, both men were accused of intentionally causing injury to a Royal Malaysia Police (PDRM) officer while the victim was performing his duties. The alleged incident occurred at Jalan Kuantan–Sungai Lembing, near the Masjid Tengku Ampuan Afzan junction, at around 9pm on 2 March.

The charges were framed under Section 332 of the Penal Code read together with Section 34, which carries a penalty of up to three years’ imprisonment, a fine, or both if convicted.

Deputy Public Prosecutor Siti Nabilla Huda Jasmani initially proposed bail of RM7,000 for each accused with one surety. However, their lawyer from the Legal Aid Foundation (YBGK), Nurul Syafiq Syeba Atan, requested a lower bail, citing financial difficulties.

She explained that the first accused was unemployed and dependent on his single mother, who works as a clinic assistant earning about RM1,500 a month while supporting two other siblings. The second accused works as a mechanic assistant with a similar income and supports his parents.

Taking into account their financial circumstances, the court set bail at RM3,000 with one surety each and scheduled the next mention of the case for 20 April.

Earlier, at the Kuantan Special Traffic Court, Muhammad Syarif also pleaded not guilty to reckless and dangerous motorcycling in a public area. The offence allegedly occurred at the same location and time, involving running a red light and weaving through traffic.

The traffic charge falls under Section 42(1) of the Road Transport Act 1987, which carries a penalty of up to five years’ imprisonment and fines between RM5,000 and RM15,000. Conviction may also result in driving license disqualification for up to 10 years.

The prosecution was handled by PDRM prosecutor Inspector Noraini Mohd Nor, while the accused were represented by YBGK lawyer Farah Atiqah Asruddin. The court fixed bail at RM3,000 with one surety and set 15 April as the next mention date for the traffic case.
