Former Sarawak Consolidated Director Charged With Providing False Statements to Bursa Malaysia

Former Sarawak Consolidated Industries Berhad director, Rosland Othman, 52, appeared in the Sessions Court here today facing charges of providing false statements to Bursa Malaysia regarding the company’s affairs five years ago.

Rosland, who is also the husband of actress Miera Liyana, remained calm throughout the proceedings. He pleaded not guilty and requested to be tried after the court interpreter read the charges before Judge Azrul Darus.

According to the charge sheet, Rosland, while serving as a director of Sarawak Consolidated at the material time, allegedly caused a false statement to be submitted to Bursa Malaysia, contained in the “Interim Financial Report on Consolidated Results for the Quarter Ended 30th June 2021.” The offence is said to have occurred at Bursa Malaysia, Exchange Square, Bukit Kewangan, on September 30, 2021.

He is charged under Paragraph 369(b)(B) read together with subsection 367(1) of the Capital Markets and Services Act 2007 [Act 671], which carries a maximum penalty of 10 years’ imprisonment and a fine of up to RM3 million upon conviction.

During the proceedings, Deputy Public Prosecutor Hashley Tajudin of the Securities Commission (SC) opposed bail, citing the serious nature of the offence. The prosecution suggested that if the court were to grant bail, it should be set at RM1 million with one surety, alongside conditions requiring the surrender of Rosland’s passport and monthly reporting to the SC until the case concludes.

Rosland’s lawyer, S. Shastidaran, requested a lower bail amount of RM5,000, arguing that his client is responsible for seven children from two marriages, two elderly dependents, and suffers from diabetes, glaucoma, and nerve problems. He also highlighted that Rosland had been declared bankrupt in 2023 and this was his first offence.

The prosecution countered that RM5,000 was too low and posed a risk of the accused absconding, noting repeated delays in recording Rosland’s statement and that bankruptcy does not necessarily prevent overseas travel.

Judge Azrul Darus eventually granted bail at RM500,000 with one surety and approved the additional conditions requested by the prosecution. The case is scheduled for remention on May 7.
