A lorry attendant was sentenced to five years in prison and fined RM20,000 by the Magistrate’s Court today after pleading guilty to reckless driving that caused the death of an elderly man last week.
Muhammad Ammar Haikal Abdullah, 22, entered the guilty plea after the charge was read before Magistrate Nur Hamizah Mat Shah.
According to the charge, the accused, who was driving a Proton Wira, drove recklessly and caused the death of Lim Seng Tee, 50, along Jalan Kulim-Mahang at about 8.30pm on May 13.
The prosecution was carried out under Section 41(1) of the Road Transport Act 1987, which provides for a jail sentence of between five and 10 years and a fine ranging from RM20,000 to RM50,000 upon conviction.
The court subsequently sentenced the accused to five years’ imprisonment effective from the date of conviction, in addition to a RM20,000 fine.
He also faces an additional eight months in jail if he fails to pay the fine. It is understood that the accused did not settle the payment.
The court further ordered the accused to be disqualified from holding a driving licence for five years.
The prosecution was conducted by deputy public prosecutor R. Jayasri, while the accused was represented by National Legal Aid Foundation lawyer Hairul Alif Hairul Azam.
