Date:

An elderly man was sentenced to one month in jail by the Magistrate’s Court here on Tuesday after pleading guilty to causing hurt to a public servant last week.

Magistrate Amal Razim Alias imposed the sentence on 66-year-old Mat Saair Setapa and ordered him to serve one month in prison if he failed to pay a RM1,000 fine.

The accused was unable to pay the fine and was subsequently ordered to serve the jail sentence.

According to the charge, Mat Saair intentionally caused injury to a 29-year-old man by slapping him on the right cheek at a house without a number in Kampung Sungai Rek at about 6.30pm on June 12.

The charge was framed under Section 323 of the Penal Code, which carries a maximum penalty of one year’s imprisonment, a fine of up to RM2,000, or both upon conviction.

The prosecution was conducted by Deputy Public Prosecutor Mazlinda Mohd Nor, while the accused was unrepresented.

Based on the facts of the case, the accused was arrested after he allegedly pushed a police lance corporal from behind and slapped the officer on the right cheek when he was asked to produce his identity card during an incident on Friday.
