Man Fined RM6,500 After Obstructing Police And Using Abusive Words

Date:

A labourer was fined RM6,500 by the Magistrates’ Court here today after pleading guilty to obstructing a police officer and using abusive language during a raid at Kampung Laklok about two weeks ago.

Mohamad Ariff Hakimi Che Ghani, 26, admitted to the charge after it was read out before Magistrate Rais Imran Hamid.

According to the charge, the accused intentionally obstructed a police officer, Sub Inspector Mohmad Zulkifli Mat, while the officer was carrying out his public duty in front of a house at Kampung Laklok at around 8.15pm on June 27, 2026.

The offence was charged under Section 186 of the Penal Code, which carries a maximum sentence of two years’ imprisonment or a fine of up to RM10,000, or both upon conviction.

Deputy Public Prosecutor Siti Asma’a Che Omar, who led the prosecution, urged the court to impose an appropriate sentence, taking into account public interest and the need to deter similar offences.

However, lawyer Nor Husniza Akmal Husain from the National Legal Aid Foundation, representing Mohamad Ariff, appealed for a lighter sentence, saying her client had admitted his mistake and promised not to repeat the offence.

She said the accused, who is single, works as a labourer earning about RM50 per day and is also responsible for supporting his parents.

Before delivering the sentence, Rais Imran reprimanded the accused for verbally insulting a police officer who was carrying out his duties.

The court then imposed a RM6,500 fine, with an additional nine-month jail term if the accused failed to pay the fine. Mohamad Ariff paid the penalty.

Based on the case facts, the accused allegedly acted aggressively during the arrest process by kicking the police officer, leading to a struggle.

During a body search, he was said to have refused to cooperate before repeatedly using insulting remarks towards the officer and later kicking the policeman involved in the arrest.
