Former prime minister Datuk Seri Najib Razak and his son, Datuk Mohd Nazifuddin, have succeeded in their bid to suspend bankruptcy proceedings over tax arrears amounting to RM1.7 billion and RM37.6 million respectively.
A three-member Court of Appeal panel, chaired by Datuk Dr Alwi Abdul Wahab, unanimously allowed their appeals today, ruling that the issues raised before the Special Commissioners of Income Tax (SCIT) were sufficiently serious to warrant a stay of the bankruptcy proceedings.
The other panel members were Datuk Dr Shahnaz Sulaiman and Datuk Ong Chee Kwan.
The Court of Appeal also set aside the Kuala Lumpur High Court’s decision on Nov 17, 2025, which had rejected their applications to suspend the bankruptcy proceedings.
The applications were made pending the outcome of their appeals before the SCIT, where they are challenging additional tax assessments issued by the Inland Revenue Board (LHDN).
The court’s decision means the bankruptcy proceedings will be put on hold while their tax appeals are being resolved.
