Former prime minister Tan Sri Muhyiddin Yassin was today discharged and acquitted of four charges involving RM200 million linked to the Jana Wibawa programme after the prosecution applied to discontinue the case.
The charges comprised one count of using his position to obtain RM200 million in bribes and three money laundering charges involving the same amount.
Deputy Public Prosecutor Datuk Ahmad Akram Gharib applied to discontinue the charges under Section 254(1) of the Criminal Procedure Code.
Judge Noor Ruwena Md Nurdin allowed the application and ordered that Muhyiddin be discharged and acquitted of all four charges.
“Accordingly, the court discharges and acquits the accused of the four charges,” she said.
However, the Pagoh MP still faces three charges of allegedly using his position to obtain RM25.3 million in bribes for Bersatu from three companies — Nepturis Sdn Bhd, Mamfor Sdn Bhd and KCJ Engineering Sdn Bhd — as well as from businessman Azman, in connection with the Jana Wibawa project.
Muhyiddin, 79, had been charged with using his position as prime minister and Bersatu president to obtain RM200 million in bribes for the party from Bukhary Equity Sdn Bhd.
The alleged offence was said to have taken place at the Prime Minister’s Office in the Perdana Putra Building, Putrajaya, between March 1, 2020 and Aug 20, 2021.
The charge was brought under Section 23(1) of the Malaysian Anti-Corruption Commission Act 2009, which carries a maximum 20-year jail term and a fine of five times the value of the bribe or RM10,000, whichever is higher, upon conviction.
Muhyiddin had also faced three charges of receiving proceeds from unlawful activities amounting to RM200 million from Bukhary Equity Sdn Bhd.
The money was allegedly deposited into Bersatu’s AmBank and CIMB Bank accounts in Petaling Jaya and Kuala Lumpur between February 2021 and July 2022.
