A woman, referred to as Xiao Hua, discovered that her husband, A Ming, had been having an affair with another woman between October 2024 and April this year. The pair reportedly met multiple times at motels and other locations to engage in sexual activities. Furious and heartbroken, Xiao Hua filed a lawsuit against the mistress, seeking NT$1.5 million (≈ RM220,000) in emotional damages.
According to the court judgment, Xiao Hua and A Ming married in 2020. Despite knowing that A Ming was married, the mistress continued an affair with him from October 2024 to April 2025, meeting frequently at motels in Tainan’s Xinying District and other residences. The affair caused Xiao Hua severe emotional distress and led to serious marital strain, prompting her to take legal action.
During the trial at the Tainan District Court, the mistress argued that she and A Ming were merely friends and denied having sexual relations. She claimed that when they met, she believed he was divorced and only learned of his marriage after Xiao Hua confronted her and called her a homewrecker, while also preventing her from collecting NT$500,000 (≈ RM73,000) she said A Ming owed her. She therefore denied causing emotional harm.
However, A Ming’s testimony contradicted her claims. He stated that they met during a training course at the Tainan Agricultural Research Station in October 2024, where he clearly mentioned he was married. Despite that, the woman expressed interest in pursuing a relationship. They first had sexual intercourse between October 28 and November 1 at a motel in Tainan’s Xinying District, and continued meeting for sexual encounters at a farmhouse from November 2024 until April 2025, before ending contact in May.
After reviewing the evidence, including photos of the pair holding hands and lying next to each other, the court concluded that their relationship was clearly beyond normal friendship. The judge ruled that the mistress’s actions had disrupted the harmony and happiness of the couple’s married life, constituting a serious violation of Xiao Hua’s marital rights and emotional well-being.
In the end, the court ordered the mistress to pay Xiao Hua NT$300,000 (≈ RM44,000) in emotional damages. The case is still open to appeal.
