A 48-year-old stateless man was sentenced on Monday to 19 years and four months’ imprisonment and 16 strokes of the cane for the rape and impregnation of his 14-year-old stepdaughter, who has a moderate intellectual disability.
The court heard a harrowing account of “calculated exploitation,” where the defendant—a bouncer at a local club—abused his position as the family’s sole breadwinner to silence a victim who functioned at the mental age of an eight-year-old.
A Profound Breach of Trust
The victim, who has an IQ of 42, lived in a one-room flat with her mother, her stepfather, and two half-siblings. According to Deputy Public Prosecutor Sruthi Boppana, the man was well aware of the girl’s profound vulnerability.
“He counted on his victim’s silence, her confusion, and her complete dependence on him,” Ms. Boppana argued. The prosecution highlighted that the victim was unable to comprehend sexual relations or how conception occurred, though she was able to state that her stepfather “gave her sex.”
The assault took place in mid-2024. After returning home drunk from a shift around 7:00 AM, the man raped the girl while her half-siblings slept nearby in the living room.
Discovery and Medical Evidence
The case only came to light in September 2024 when the victim was taken to the hospital complaining of abdominal pains. Doctors discovered she was pregnant, prompting a mandatory police report due to her age and status as a minor.
The victim eventually gave birth, and the infant has since been placed with a foster family. Paternity tests later confirmed the defendant was the father.
The Sentencing Ruling
Justice Audrey Lim, in delivering the judgment, emphasized the need for deterrence and retribution.
- The Harm: The judge noted that the man’s actions violated the victim’s dignity and sexual autonomy, leaving “irretrievable physical, emotional, and psychological scars.”
- The Aggravating Factors: The victim’s young age, her intellectual disability, and the resulting pregnancy were cited as reasons for the heavy sentence.
- The Legal Threshold: While the maximum sentence for rape is 20 years, the term can be doubled when the offender is in a position of trust or a close relationship with the victim.
Defense and Mitigation
Defense counsel Ms. Mumtaj Banu stated that her client was “truly remorseful” and “ashamed.” She argued for a sentence at the lower end of the prosecution’s proposed range, noting that the man hoped to eventually leave prison as a “reformed person” to rebuild his family.
Notably, the court heard that the man’s wife had previously been warned by her other daughter about the man’s behavior, but had initially chosen to trust her husband. To date, neither spouse has filed for divorce.
