Two army personnel holding the rank of Koperal were each fined RM2,200 by separate Magistrates’ Courts after admitting to assaulting two fellow servicemen earlier this month.
The accused, Mohamad Izzuddin Ahmad, 27, and Muhamad Amir Irfan Mohd Ridzuan, 25, entered their guilty pleas after the charges were read before Magistrate Muhammad Syaiful Akmal Mohamad Razi and Magistrate Mohamad Azlan Basri in separate proceedings.
In the first case, both men were charged with causing injury to a 25-year-old male colleague inside a bachelor accommodation room at the 165 Intelligence Battalion, Sungai Layar Airfield Camp. The offence was allegedly committed between 10.05pm and 11.50pm on 5 March.
Each was fined RM700 for the charge, with a default sentence of 14 days’ imprisonment if the fine is not paid.
In a second proceeding before Magistrate Mohamad Azlan Basri, both accused were again charged with injuring another 25-year-old serviceman at the same location, date and time. For this offence, they were each fined RM1,500, with an alternative two-month jail term if they fail to settle the payment.
Both cases were prosecuted under Section 323 of the Penal Code, which provides for a maximum penalty of one year’s imprisonment, a fine of up to RM2,000, or both upon conviction.
Prosecutors Adlin Sufiya Kamaruzzaman and Nur Hazwani Md Noor handled the case, while defence counsel Chong Sen Ming represented both accused.
The defence appealed for leniency, citing that the two soldiers are unmarried, earning modest incomes, and supporting ill parents in their hometown. It was also stated that both had no prior criminal record and had cooperated fully during police investigations.
However, the prosecution urged the court to impose an appropriate sentence to serve as a deterrent and to prevent similar incidents from recurring within the armed forces.
