The Attorney General’s Chambers (AGC) has filed an appeal against the Shah Alam High Court’s decision to acquit and discharge a 15-year-old boy accused of murdering a schoolmate at a secondary school in Bandar Utama last year.
In a statement, the AGC said it filed the notice of appeal at the Court of Appeal on September 22, following a review of the High Court’s decision.
“After considering the decision of the Shah Alam High Court judge, this department filed a notice of appeal at the Court of Appeal on September 22 to appeal against the decision to discharge and acquit,” it said.
The teenager had previously been charged with murdering a 16-year-old female student inside a girls’ toilet at a secondary school in Bandar Utama.
The alleged offence took place between 9.20am and 9.35am on October 14, 2025.
The victim was reportedly found to have suffered around 180 stab wounds in the incident.
The teenager was charged under Section 302 of the Penal Code.
On August 13, the Shah Alam High Court ordered the teenager to enter his defence after finding that the prosecution had established a prima facie case against him.
However, the court subsequently acquitted and discharged him after finding that he was mentally unsound at the time of the incident.
The AGC has now brought the matter before the Court of Appeal, seeking to challenge the High Court’s decision.
Under Section 97(1) of the Child Act 2001, the death penalty cannot be imposed on a person who was a child at the time the offence was committed.
