Bankrupt Man Faces 207 Charges Over Company Director Abuse

A 62-year-old man who is currently a bankrupt has pleaded not guilty in the Magistrate’s Court Jawi on Thursday to 207 charges involving the alleged unlawful use of a company director position and entering into business contracts.

The accused, Tang Wee Tat, entered his plea after all charges were read to him in Bahasa Malaysia before Magistrate Nurul Aina Ahmad.

According to the first six charges, Tang is alleged to have signed six letters of acceptance using his position as a company director despite his bankrupt status.

The former project manager is said to have committed these offences between 10 May 2023 and 21 August 2023.

He is also accused of signing 201 official company letters in the same capacity to conduct business dealings.

The alleged offences reportedly took place between 26 November 2021 and 6 May 2024 in the Batu Kawan area of Seberang Perai Selatan.

The charges state that as an undischarged bankrupt, Tang allegedly entered into contracts and conducted business activities by signing letters of award and official correspondence as a director of Global Max Resources Sdn Bhd with Lien Dak Engineering Sdn Bhd.

It is further alleged that he failed to disclose his bankrupt status to the contracting company prior to entering into the agreements.

The offences are framed under Section 109(1)(m)(ii) of the Insolvency Act 1967, which provides for a maximum penalty of two years’ imprisonment, a fine, or both upon conviction.

During proceedings, the investigating officer proposed bail of RM5,000 for each charge.

However, the defence requested a reduction, citing the accused’s financial situation, medical condition, and personal responsibilities.

The court subsequently set bail at RM60,000 and fixed 28 July for document submission.
