A consultancy and employment services company and its director have pleaded not guilty to 14 charges of failing to pay service tax and penalties amounting to RM48,249.44.
Teraju MHA Group Sdn Bhd and its director, Mohammad Habibullah Awang, 43, each claimed trial to seven separate charges before Sessions Court Judge Wan Suhaila Mohd on Tuesday.
According to the charges, the company, represented by Mohammad Habibullah as the accused, allegedly failed to pay service tax totalling RM34,463.90.
The company was also charged with failing to pay RM13,785.54 in penalties for taxable periods between May 1, 2023 and Oct 31, 2024.
The offences were allegedly committed at the Royal Malaysian Customs Department’s Kemaman Station in Kuala Kemaman.
Teraju MHA Group, which operates in the Teluk Kalong Industrial Area, was charged under Section 26(8) of the Service Tax Act 2018, which carries a maximum penalty of RM50,000, imprisonment of up to three years, or both, upon conviction.
Mohammad Habibullah, in his capacity as the company’s director, also faces the same charges and potential penalties under the law.
The court allowed him bail of RM12,000 pending further proceedings.
