Court Of Appeal Upholds 10-Year Jail Term And Caning For Sodomy Conviction

The Court of Appeal today upheld the 10-year prison sentence and two strokes of the cane handed to C. Logenthiran for sodomising a teenager in 2020.

A three-member bench led by Justice Datuk Azman Abdullah unanimously dismissed Logenthiran’s appeal against his conviction and sentence.

Justice Azman noted that court records confirmed no conditional plea had been made prior to sentencing in the Sessions Court. He added that Logenthiran’s plea of guilt was properly made with full knowledge and aligned with the facts of the charge.

During the appeal, Logenthiran was represented by M. Kartan from the National Legal Aid Foundation, who argued that his client had entered a conditional plea as part of an informal plea bargain and requested the case be remitted for trial. Kartan also informed the court that Logenthiran is a transgender individual who had undergone procedures to transition to female.

Deputy Public Prosecutor Hafizah Johor Ariff Johor stated that the charge had been fully explained and understood by the appellant, and no issues regarding a conditional plea were raised during earlier proceedings.

The Kuala Kangsar Sessions Court originally sentenced Logenthiran in 2024 after he pleaded guilty to committing carnal intercourse against the order of nature on a 15-year-old victim at a temple in Hulu Perak, Perak in February 2020.

The Sessions Court also ordered him to undergo counselling in prison and remain under police supervision for two years following his release. The High Court subsequently dismissed his initial appeal in 2025, upholding the Sessions Court’s ruling.
