A pasar malam trader has been sentenced to 12 years in prison and three strokes of the rotan after pleading guilty to raping his best friend’s 14-year-old disabled daughter, who later became pregnant.
Judge Mohd Khairi Haron imposed the sentence on Lim Khin Tai, 49, after taking into account his guilty plea and mitigation.
The court also ordered Lim to undergo counselling while serving his sentence and placed him under police supervision for two years after his release.
Lim committed the offence in a bedroom at a house here at about 8am on March 8, 2024.
He was charged under Section 376(1) of the Penal Code, which provides for imprisonment of up to 20 years and caning upon conviction.
According to the facts of the case, the victim discovered she was pregnant during a medical examination on July 7, 2024.
She subsequently told her family that Lim had raped her. Lim was also the family’s neighbour and had known the victim since she was a child due to his frequent visits to their home.
The court heard that Lim had gone to the house and asked the victim to open the door, claiming that he wanted to look at her father’s fish.
He then brought her into a room and raped her while her family members were away at work.
The victim later identified Lim as the person responsible, leading to his arrest following a police report.
Deputy Public Prosecutor Amirah Sapian prosecuted the case, while Lim was represented by lawyer Salmi Hamdan Sabran.
