Two Charged Over Alleged Trafficking Of More Than 4kg Of Dangerous Drugs

A Malaysian man and a Thai woman were charged at the Magistrate’s Court here today with three counts of alleged drug trafficking involving several types of dangerous drugs, as well as one count of drug possession.

The accused, Chong Ding Hun, 38, from Kedah, and Thai national Miss Nichakarn, 35, appeared before Magistrate Siti Aisyah Ahmad. However, no plea was recorded from both accused as the case falls under the jurisdiction of the High Court.

According to the first charge, the duo was accused of jointly trafficking 2.614kg of ketamine found inside a silver Mazda CX-5 vehicle.

The alleged offence was said to have taken place at around 7pm on June 29 at the Basement 1 parking exit ramp of Geo Resort & Hotel, Genting Highlands, Bentong.

For the second charge, both accused were alleged to have trafficked 671g of MDMA at the same location, date and time.

The third trafficking charge involved 1.10kg of cocaine, which was also allegedly committed at the same place and time. All three charges were framed under Section 39B(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 39B(2) of the same Act, read together with Section 34 of the Penal Code.

The pair also faced an additional charge of jointly possessing 4.30g of nimetazepam under Section 12(2) of the Dangerous Drugs Act 1952, which carries penalties under Section 12(3) of the same Act, read with Section 34 of the Penal Code.

If convicted for drug trafficking offences, the accused may face the death penalty or life imprisonment. If the death sentence is not imposed, they may also be sentenced to at least 15 strokes of the cane.

For the possession charge, the offence carries a maximum fine of RM100,000, imprisonment of up to five years, or both upon conviction.

Deputy Public Prosecutor Hardave Singh led the prosecution, while no bail was offered for both accused.

The court fixed August 20 for the next mention of the case and also ordered that a Thai interpreter be provided for Miss Nichakarn during future proceedings.
