Rus’sele Eizan, Speaker of the Perlis State Assembly, has filed an application to dismiss an originating summons brought against him by three former state assemblymen. The application was submitted on Monday, according to his lawyer, Wan Rohimi Wan Daud.
During a case management session at the Kangar High Court, the court set March 25 as the deadline for the plaintiffs to file their reply to Rus’sele’s affidavit. A further reply by the defendant is due by April 15, with a proceeding on April 16 to schedule the hearing date.
The three former assemblymen—Mohd Ridzuan Hashim (Guar Sanji), Fakhrul Anwar Ismail (Bintong), and Saad Seman (Chuping)—filed the suit on January 2, challenging Rus’sele’s declaration of casual vacancies in the seats they formerly held.
The speaker announced the vacancies on December 25 last year, stating that the three PAS members’ seats were vacated with immediate effect. This followed a statement by Tan Sri Abdul Hadi Awang a day earlier, who confirmed that the memberships had ceased under the PAS Constitution.
