A restaurant owner was fined RM2,000 by the Batu Gajah Magistrate’s Court on Friday after pleading guilty to intentionally harming and killing a stray dog using a firecracker in January.
Magistrate Azlin Zeti Zainal Abidin also ordered 64-year-old Wong Phan Sang to serve a two-month jail term if he fails to pay the fine.
According to the charge, Wong was accused of committing mischief by killing a stray dog outside a restaurant on Jalan Seroja, Taman Pusing Baru, Pusing, Batu Gajah, at around 7.30 pm on 28 January 2026.
The case was brought under Section 428 of the Penal Code, which carries a maximum penalty of three years’ imprisonment, a fine, or both upon conviction.
The prosecution was led by Deputy Public Prosecutor Monisha Pandey, while Wong was represented by lawyer Choong Hui Yean.
Evidence showed that the accused threw a firecracker at the stray dog, resulting in its death, and the act was captured on the CCTV of a nearby premises.
Following a police report, officers from the Criminal Investigation Division of Batu Gajah District Police Headquarters arrested Wong on 30 January at the police station.
During investigations, Wong led the authorities to his home and handed over a plastic container containing a lighter and six multi-coloured ball-type firecrackers.
This case highlights the increasing use of CCTV in monitoring animal cruelty and serves as a warning that such acts carry serious legal consequences.
