Driver Jailed One Month And Fined RM10,000 For Drink Driving

Two men, including a 75-year-old, have been sentenced to jail and fined RM10,000 each after pleading guilty at the Magistrates’ Court for driving under the influence of alcohol beyond the legal limit.

The elderly accused, Ho Lee Ming @ Ho Kon Fook, was sentenced to one month in prison and fined RM10,000, with an additional three months’ jail in default of payment.

He was found to have driven a Perodua Ativa along Batu 7, Jalan Apas at 8.45pm on April 19 with a blood alcohol level of 133 milligrams per 100 millilitres of blood, exceeding the legal limit of 50 milligrams.

He was charged under Section 45A(1) of the Road Transport Act 1987 and pleaded guilty to the offence.

In mitigation, Ho told the court that he was unemployed and survived by selling flowers grown at home, adding that he lived alone.

In a separate case, a 27-year-old mechanic, Henry Chai Hor Ming, was sentenced to one day in jail and fined RM10,000, with a three-month jail term in default of payment after admitting to a similar offence.

He was charged with driving a Toyota Hilux with a blood alcohol level of 122 milligrams per 100 millilitres of blood before losing control and crashing into a concrete barrier along Jalan Sin On at about 1am on February 20.

In his plea for leniency, he said he needed to care for his parents and send his grandmother to hospital.

The court also ordered both men to be disqualified from holding or obtaining a driving licence for two years with immediate effect.

The prosecution was conducted by a traffic enforcement officer, while both accused were unrepresented.
