Malaysian Bar Wins Appeal To Challenge AG’s DNAA Decision In Zahid Case

The Malaysian Bar has successfully won its appeal to proceed with a judicial review challenging the Attorney General’s 2023 decision to apply for a discharge not amounting to an acquittal (DNAA) in Datuk Seri Ahmad Zahid Hamidi’s corruption case.

The case involves 47 charges linked to the Yayasan Akalbudi corruption trial.

A three-judge panel at the Court of Appeal, chaired by Faizah Jamaludin, ruled unanimously that the Malaysian Bar’s legal challenge can move forward to be heard at the High Court.

“Leave is granted to the appellant to commence judicial review against the Attorney General’s impugned decision. The matter is remitted to the High Court for substantive hearing of the judicial review,” she said, referring to the Malaysian Bar as the appellant.

The panel also comprised judges Lim Hock Leng and Nadzarin Wok Nordin.

The decision marks a significant development in the legal dispute over prosecutorial discretion in the high-profile corruption case involving Datuk Seri Ahmad Zahid Hamidi.

The High Court is now expected to hear the substantive judicial review on the Attorney General’s decision regarding the DNAA application.
