Man Fined RM3,500 for Attacking Ex-Wife with Helmet in Johor

Date:

A 31-year-old man was fined RM3,500 by the Magistrate’s Court in Pasir Gudang on Thursday after pleading guilty to injuring his ex-wife with a motorcycle helmet last Sunday.

The accused, Mohammad Firdaus Osman, admitted to the charge before Magistrate Atifah Hazimah Wahab after it was read in court.

According to the charge sheet, he intentionally caused injury to his 34-year-old former wife by striking her with a helmet — considered a dangerous weapon capable of causing death. The incident occurred at a house in Kampung Sentosa, Pasir Gudang, at around 5.30pm on August 31.

Case facts revealed that Firdaus struck the victim’s head and neck with the helmet, causing injuries to both areas. He was charged under Section 324 of the Penal Code, which carries a maximum penalty of 10 years in prison, or a fine, or whipping, or any combination of the punishments upon conviction.

Deputy Public Prosecutor Sarah Siti Aisyah Mustapha Kamal urged the court to impose a fitting sentence, citing the harm inflicted on the victim.

However, his lawyer from the National Legal Aid Foundation (YBGK), Nurul Hidayah Mohammad Asri, pleaded for leniency, noting that Firdaus has three children, two of whom are under his care, and that he works as a wedding canopy installer. She also highlighted his cooperation with investigators and his guilty plea.

The court imposed a RM3,500 fine, with six months’ imprisonment in default.

In a separate case heard before the same court, a farmer, K. Raju, 50, was sentenced to four months in jail after admitting to assaulting his wife in August.

The offence took place at their home in Taman Bukit Tiram, Ulu Tiram, at 2.40am on August 6. Raju was charged under Section 323 of the Penal Code, read with Section 326A, which provides for up to two years’ imprisonment.

He also received another four-month jail term for threatening to kill his 45-year-old wife during the same incident, an offence under Section 506 of the Penal Code, which carries a maximum of seven years in prison, a fine, or both.

Raju’s YBGK lawyer, Siti Nabilah Hamzah, told the court that he earns RM1,400 a month, supports his parents, and has three children. She added this was his first offence, that he had been remanded since August 6, and that he deeply regretted his actions.
