A 47-year-old female teacher was charged at the Magistrate’s Court today for allegedly injuring a seven-year-old pupil by throwing a whiteboard eraser that left the child with bruising near the eye.
The accused, Fakhriah Bustani, pleaded not guilty after the charge was read before Magistrate Mustaqim Sukarno. She was charged under Section 323 of the Penal Code for voluntarily causing hurt.
According to the charge, she is accused of intentionally causing injury to the pupil at a national school in Tongkang Pecah at about 9am on 1 April.
The offence carries a maximum penalty of one year’s imprisonment, a fine of up to RM2,000, or both upon conviction.
Deputy public prosecutor Firdaus Ruslan led the prosecution, while the accused was represented by lawyer Normaahani Rais from the National Legal Aid Foundation (YBGK).
The court allowed bail of RM1,500 and set 21 August for the next mention to allow for document submission.
Based on earlier reports, the victim allegedly returned home and informed another teacher, who is also the accused, that she had thrown a whiteboard eraser which struck her near the eye.
Investigations indicated the act was allegedly committed after the teacher claimed the pupil was not paying full attention during class.
The eraser reportedly hit the area under the right eye, causing injury.
Medical examination later confirmed that the injuries sustained were consistent with the alleged act.
