A 56-year-old Indonesian man has been sentenced to 60 years in prison after pleading guilty to six charges of raping his biological daughter over a five-year period.
The Sessions Court here also ordered the accused, who has lived in Malaysia for 43 years, to receive 60 strokes of the cane. The jail sentence will begin from the date of his arrest on July 23.
Judge Mazuliana Abdul Rashid handed down the sentence after the man admitted to all charges brought against him.
The offences were committed at a residential unit in Taman Midah, here, between 9.30pm on Oct 2, 2021 and 3.32pm on June 30, 2026.
The accused was charged under Section 376(3) of the Penal Code, which carries a jail term of between eight and 30 years, as well as whipping upon conviction.
Deputy Public Prosecutor J. Banusha told the court that a heavy sentence was appropriate due to the accused’s position as the victim’s biological father and the serious impact of the offences on the victim.
She said the victim suffered severe emotional distress following the repeated incidents and had previously expressed thoughts of ending her life, but remained strong for the sake of her four-year-old child.
The court was also informed that the accused had previously faced allegations involving sexual offences against the victim’s four-year-old child.
Based on the case facts, the victim was first abused on Oct 2, 2021 while staying with the accused, with the incidents occurring repeatedly at the same location until June this year.
The victim later became pregnant in April 2022 and gave birth to a baby girl on July 11 of the same year.
The accused had allegedly threatened the victim to prevent her from disclosing the matter to her stepmother or other individuals.
A DNA analysis report later confirmed that the accused was the biological father of the baby.
Earlier, the accused, who was not represented by a lawyer, had requested for a lighter sentence.
