Three Form One students were charged at the Magistrates’ Court here today with allegedly injuring a 13-year-old schoolmate by throwing a slipper at him and slapping his head.
However, only two of the three 13-year-old accused pleaded guilty after the joint charge was read before Magistrate Mustaqim Sukarno.
According to the charge, the three students allegedly acted together to intentionally cause injury to the 13-year-old victim at a secondary school along Jalan Kluang here at around 5.25pm on April 6.
They were charged under Section 323 of the Penal Code, read together with Section 34 of the same law, which deals with voluntarily causing hurt and acts carried out with a common intention.
If convicted, the offence carries a maximum jail term of one year, a fine of up to RM2,000, or both.
Based on the facts of the case, the victim alleged that all three accused had thrown a slipper at his head and slapped him while he was being picked up from school by a family member.
The incident allegedly left the victim with an injury to his head, prompting him to lodge a police report for further action.
The prosecution was handled by Deputy Public Prosecutor Nur Shahzleen Ibrahim, while all three students were represented by lawyer Tan Song Yan from the National Legal Aid Foundation (YBGK).
The court ordered the two students who pleaded guilty to perform 90 hours of community service within six months.
Their parents were also ordered to enter into a three-year good behaviour bond with a RM1,000 surety.
The court further imposed a curfew on the two students, requiring them to remain at home between 10pm and 6am, and ordered them to report to the authorities once every two months throughout the bond period.
