Former Marketing Executive Jailed Five Years, Caned For RM6.21 Million Company Fraud

A former marketing executive has been sentenced to five years in prison and up to 24 strokes of the cane after being found guilty of 26 charges linked to a fraud that caused a company to lose more than RM6.21 million three years ago.

Magistrate Tan Sri Steven Malanjun imposed the sentence on the 38-year-old accused, Moh Chuan Leong, after the prosecution successfully proved its case at the end of the trial.

The accused was sentenced to five years’ imprisonment and one stroke of the cane for each of the 26 charges. However, all prison terms will run concurrently.

Under Section 288(5) of the Criminal Procedure Code, the court could impose a maximum of 24 strokes of the cane.

The accused was alleged to have submitted two falsified monthly oil palm sales reports between February 2023 and February 2024 at an office in a commercial centre.

The reports were allegedly submitted under the names of his companies, Ampel Agent and Sawit Borneo Sdn Bhd, as part of a scheme to deceive his employer and induce the company secretary to release RM6,212,266.84.

He was charged under Section 420 of the Penal Code, which provides for up to 10 years’ imprisonment, whipping and a fine upon conviction.

The trial began on April 24, 2025, with the prosecution calling 24 witnesses to testify. The accused was the sole defence witness.

Deputy public prosecutor Wildan Firdous prosecuted the case, while the accused was represented by lawyer Tan Wen Jie.
