Ex-TNB Engineer Fined RM150,000 for Cheating Tender Committee in RM4.3m Project

A former Tenaga Nasional Berhad (TNB) assistant engineer has been ordered to pay a RM150,000 fine by the Sessions Court for cheating a tender evaluation committee in connection with a RM4.34 million cable line project back in 2016.

Zamhuri Ahmad Shatiry, 51, pleaded guilty to the charge under Section 415 of the Penal Code, punishable under Section 417, which carries up to five years’ jail, a fine or both. He will serve six months in jail if he fails to pay the fine.

The offence took place on August 1, 2016, at the Kinta District Energy Distribution Division meeting room, where Zamhuri acted as committee secretary for a TNB tender related to the installation and commissioning of a 33kV Aerial Bundle Cable from PMU Kampar to PPU Gopeng Industrial in Perak.

He failed to disclose his interest in Gua Besar Sdn Bhd, the company that eventually secured the tender. Investigations showed he had personally prepared the bill of quantities and pricing, enabling the company to successfully submit the RM4,337,542 proposal through TNB’s online system.

After project completion in 2018, Zamhuri received three cheques totalling RM140,000, handed over at a coffee shop in Kuala Kangsar to two intermediaries acting on his behalf, as a reward for facilitating the contract win.

Malaysian Anti-Corruption Commission (MACC) prosecuting officer Mohd Afiq Mohd Adnan handled the case. Zamhuri was not represented by legal counsel.

In mitigation, he expressed remorse, stating he was responsible for caring for his four children and his mother.

“I admit my wrongdoing and regret my actions,” he told the court.

He promptly paid the fine.
