A 42-year-old man who went viral for allegedly detaining and injuring a 14-year-old boy in an apartment in Bukit Kemuning last week was sentenced to 15 months’ imprisonment by the Magistrate’s Court on Friday.
The accused, Mohamad Fadwan Abd Muaain, who works as a debt collector, pleaded guilty to the charges before Magistrate Wan Noora Nisa Ngadirin.
For the offence of wrongful confinement, the divorced father of one was sentenced to nine months in prison starting Friday. For the assault charge involving the same victim, he was given a further six months’ jail, to be served after completing the first sentence.
According to the first charge, the man allegedly confined the 14-year-and-one-month-old victim by restraining his hands and legs at an apartment unit in Section 32 between 8.05am and 11.50am on May 11.
The charge was framed under Section 342 of the Penal Code, which provides for imprisonment of up to one year, a fine, or both upon conviction.
For the second charge, he was accused of causing hurt to the same victim at the same time and location under Section 323 of the Penal Code, which carries similar penalties.
The prosecution was conducted by deputy public prosecutor Nur Amirah Zahari, while the accused was represented by a lawyer from the National Legal Aid Foundation (YBGK), Adli Hakim Azami.
In a separate proceeding at the Sessions Court, the same man also pleaded guilty to a charge of physical sexual assault against the same victim involving the same incident.
He was charged under Section 14(d) of the Sexual Offences Against Children Act 2017, which carries a maximum penalty of 20 years’ imprisonment and whipping upon conviction.
The case was prosecuted by deputy public prosecutor KS Rinisha Priyya, while the accused was unrepresented.
Judge Rasyihah Ghazali fixed June 8 for the submission of facts and sentencing.
