Married Couple Faces Court Over RM56k Company Fund Misuse for Personal Rent

A married couple appeared in the Sessions Court here on Tuesday, facing two charges of misusing company funds totaling RM56,000 to pay for their rental home in 2021 and 2022.

Nor Atiqah Mohamad Alwi, 36, and her husband Muhamad Fakhrullah Abd Rahim, 37, pleaded not guilty when the charges were read before Judge Mohd Azhar Othman.

According to the charges, Nor Atiqah, then director of A2 Wax Sdn Bhd, and her husband were accused of dishonestly misusing RM49,000 and RM7,000 from the company account to pay rent for a Puchong, Selangor office, which was actually their residence. The alleged offences took place at the company office on August 29 and November 23, 2021, and January 31, 2022.

They were charged under Section 403 of the Penal Code read together with Section 34, which carries a penalty of six months to five years’ imprisonment, whipping, and a fine if convicted.

The court granted bail of RM8,000 each with one surety, required them to surrender their passports, report monthly to the nearest Malaysian Anti-Corruption Commission (MACC) office, and prohibited them from interfering with prosecution witnesses. The case is set for remention on November 4.

The prosecution was handled by MACC Deputy Public Prosecutor Rabiatul Addawiah Mohd Noorlee and MACC officer Nur Raihan Mohd Yusof, while the couple was represented by lawyer Abdul Rahman Ab Razak.

In the same courtroom, former Assistant Community Development Officer Muhammad Maududi Abd Rashid, 36, was fined RM6,000 after pleading guilty to three charges of accepting bribes totaling RM2,100 two years ago in exchange for registering a daycare centre owned by a woman who is also a chairman of an organisation and company director.

The offences under Section 165 of the Penal Code occurred at a bank in Jertih between July and September 2023. Judge Mohd Azhar imposed a fine of RM2,000 per charge or two months’ imprisonment if unpaid, warning that such acts could become a “cancer” in society if left unchecked.

The prosecution was handled by Nur Raihan, and the accused was not represented by a lawyer.
