Former Nightclub Bouncer Jailed Five Years For Assault That Left Man Blind In One Eye

Date:

A former nightclub bouncer has been sentenced to five years in prison after being found guilty of assaulting a man and causing him to lose sight in his right eye during an incident nearly a decade ago.

Sessions Court Judge Mazuliana Abdul Rashid handed down the sentence to Jamsari Idris, 53, after ruling that the defence had failed to raise reasonable doubt at the end of the defence case.

According to the charge, Jamsari was accused of causing grievous hurt to Muhammad Ramdhan Aidil Norsham, 28, at a nightclub in the Dang Wangi area of Kuala Lumpur at approximately 3.30am on November 6, 2016.

The offence was prosecuted under Section 325 of the Penal Code, which carries a maximum penalty of seven years’ imprisonment and a fine upon conviction.

In delivering her judgment, Judge Mazuliana rejected the defence’s argument that the accused had not been named in the initial police report.

The court held that there was no doubt regarding the victim’s identification of Jamsari as the individual who punched him during the incident.

The judge also found the accused’s version of events to be unreasonable. During his defence, Jamsari claimed he had merely tried to calm the victim down, but the court did not accept his explanation.

Before sentencing, the court heard a victim impact statement detailing the lasting effects of the attack on Muhammad Ramdhan’s life following the loss of vision in his right eye.

The victim told the court that before the assault, he had enjoyed normal eyesight and was able to carry out everyday activities without difficulty.

“Before the incident, I could clearly see, hold a glass without dropping it, ride a motorcycle and drive a car like anyone else,” he said.

“However, after the incident, my life changed completely. I was later involved in an accident when the motorcycle I was riding hit a pothole, causing three of my toes to be fractured.”

The prosecution was led by Deputy Public Prosecutor Ravindejit Kaur, while Jamsari was represented by lawyer Shah Rizal Abdul Manan.
