High Court Rejects Appeal by Zayn Rayyan’s Mother to Defer Five-Year Jail Term

The High Court today dismissed an appeal by Ismanira Abdul Manaf, the mother of the late Zayn Rayyan Abdul Matin, to defer the five-year prison sentence she is currently serving.

In delivering the ruling, Judge Datuk Aslam Zainuddin said the court found no special circumstances or legal grounds to justify granting a stay of execution of the sentence. The decision was made after considering written submissions and hearing oral arguments from both the defence and the prosecution, Utusan Malaysia reported.

“The court rejects the application and finds that there are no special circumstances or elements that would allow the postponement to be approved,” the judge said.

Ismanira was represented by lawyers Haresh Mahadevan, Ramzani Idris and Lavanesh Haresh, while the prosecution was led by Deputy Public Prosecutors Mohd Izham Ali and Ahmad Iqbal Azman.

On Oct 31, Judge Dr Syahliza Warnoh sentenced Ismanira to five years’ imprisonment at Kajang Prison after finding her guilty of neglecting her son. The court also ordered a two-year good behaviour bond with a RM3,000 surety to be furnished by a Malaysian citizen, as well as 120 hours of community service to be completed within six months after her release.

The 30-year-old was convicted after the defence failed to raise reasonable doubt at the close of the trial. Under the amended charge, she was accused of neglecting Zayn Rayyan while having custody of him, in a manner likely to cause physical injury.

The offence was said to have occurred between noon on Dec 5, 2023, and 9.55pm on Dec 6, 2023, around Block R of Pangsapuri Idaman, Damansara Damai, extending to a nearby river close to Apartmen Idaman.
