A lorry attendant was sentenced to 38 months’ imprisonment by the Magistrate’s Court on Wednesday after pleading guilty to kidnapping and injuring a 14-year-old girl last week.
Magistrate Nur Hamizah Mat Shah handed down the sentence after the 39-year-old accused, M Shyrichs, admitted to two charges brought against him.
For the first charge, the court heard that the accused kidnapped the 14-year-and-three-month-old victim in front of Sekolah Menengah Kebangsaan Dato Lela Pahlawan Padang Serai at about 6.30pm on July 23.
The offence was charged under Section 361 of the Penal Code and punishable under Section 363, which carries a maximum penalty of seven years’ imprisonment and a fine upon conviction.
The accused also pleaded guilty to intentionally causing hurt to the victim at the same location, date and time. The charge was framed under Section 323 of the Penal Code, which provides for up to one year’s imprisonment, a fine of up to RM2,000, or both.
The court sentenced the accused to 38 months’ imprisonment for the kidnapping charge, effective from the date of his arrest. He was also sentenced to five months’ imprisonment for causing hurt, with the jail term to commence from the same date.
The prosecution was led by Deputy Public Prosecutor Nur Ain Fadilla Mohamad Fauzi, while the accused was represented by National Legal Aid Foundation lawyer V Nyanasegaran.
