A 25-year-old man has been sentenced to six years in prison and fined RM20,000 after pleading guilty to dangerous driving that resulted in the death of a motorcyclist in Gelang Patah last week.
T. Yuken entered his guilty plea after the charge was read to him in Tamil before Magistrate Nur Fatin Mohamad Farid at the Magistrates’ Court on Monday.
The court also ordered Yuken to pay RM4,000 in compensation to the victim’s wife, Noor Adlin Roslan. He faces an additional year in prison if he fails to settle the fine.
Yuken was further ordered to have his driving licence endorsed by the court and disqualified from holding or obtaining a driving licence for five years. If he holds a probationary licence, it will also be revoked.
The charge stated that Yuken had driven his car dangerously in a manner that posed a risk to members of the public, resulting in the death of 41-year-old Muhamad Isa Damiri at Jalan Leong Bee, Gelang Patah, at around 4.20am on Aug 6.
According to the facts of the case, Yuken was driving a Perodua Myvi when he entered the opposite lane and collided with the Honda C100B motorcycle ridden by Muhamad Isa, who was travelling straight.
The impact caused the motorcyclist to die at the scene. A medical officer from Hospital Sultanah Aminah confirmed that the cause of death was multiple injuries consistent with a road accident.
Yuken, who was unrepresented by a lawyer, apologised to the court and appealed for a lighter sentence, saying he regretted his actions and acknowledged his mistake.
However, Deputy Public Prosecutor Muhaizam Rostam Affendi urged the court to consider the aggravating factors before determining the sentence.
Yuken was charged under Section 41(1) of the Road Transport Act 1987, which provides for a maximum prison sentence of 10 years and a fine of up to RM50,000 upon conviction, along with possible driving licence disqualification.
The court fixed Dec 10 for a mention to check the status of the compensation payment. Should the compensation remain unpaid, the court will determine the appropriate further order.
