A 29-year-old man pleaded not guilty at the Sepang Sessions Court today to a charge of uploading an obscene video on TikTok relating to a pig farm project.
Mohamad Norfirdaus Abdul Rahman entered his plea after the charge was read before Judge Ahmad Fuad Othman.
According to the charge, Mohamad Norfirdaus allegedly uploaded a four-minute video containing obscene communication concerning a pig farm project at about 4.11am on Jan 12 through his TikTok account, “nowad.acc4”.
The prosecution alleged that the communication was made with the intention of causing annoyance, abusing, threatening or harassing another person.
He was charged under Section 233(1)(a) of the Communications and Multimedia Act 1998, punishable under Section 233(2) of the same Act.
If convicted, he could face a fine of up to RM500,000 or imprisonment for up to two years, or both. An additional fine of RM5,000 may also be imposed for each day the offence continues after conviction.
Malaysian Communications and Multimedia Commission (MCMC) prosecuting officer Mohamad Azmir Mohd Razali requested bail of RM10,000 with one Malaysian surety.
However, lawyer Azi ‘Azlin Zulkifli, representing Mohamad Norfirdaus, appealed for a lower bail amount, saying his client was responsible for supporting both of his parents.
“My client is a technician at a factory in Banting earning RM3,000 a month and has to support both of his elderly parents in his hometown,” she said.
The court subsequently granted bail at RM6,000 with one surety and fixed Oct 7 for mention of the case.
Mohamad Norfirdaus paid the bail amount.
