Datin Seri Rosmah Mansor may now face enforcement proceedings over nearly RM67.5 million in compensation after the Court of Appeal unanimously rejected her bid for an unconditional stay of execution.
A three-member panel led by Datuk Seri Mohd Firuz Jaffril dismissed Rosmah’s application, finding no reasonable grounds to grant the stay. She was also ordered to pay RM30,000 in legal costs.
On June 10, the High Court ordered the 75-year-old wife of former prime minister Najib Razak to pay RM67,461,027.37 after finding her liable for the loss of 43 pieces of jewellery worth US$14.57 million belonging to Lebanese jeweller Global Royalty Trading SAL.
On Aug 12, Judicial Commissioner Marianne Antoinette Ghani allowed the payment to the company to be stayed, but ordered the compensation amount to be deposited into a trustee account within a month pending the outcome of the full appeal.
However, lawyer Datuk David Gurupatham said Rosmah had breached the court’s stay conditions by failing to make the required payment, meaning the stay had automatically lapsed.
He said Global Royalty Trading SAL was now prepared to enforce the judgment, including seeking enforcement through the High Court or taking action against other assets.
Gurupatham also questioned evidence presented on Rosmah’s financial position, saying the appeal had focused mainly on the jewellery while a dormant bank account allegedly containing only RM20 was presented as evidence of her financial resources.
