An Indonesian undocumented immigrant pleaded guilty in the Sessions Court here today to the charge of raping his underage foster sister at an unnumbered house near Semporna last month.
The accused, a 33-year-old Indonesian national, made the plea before Judge Ahmad Faizadh Yahaya.
According to the charge, he was accused of raping the 15-year-old schoolgirl at the victim’s house around 4:30 a.m. on September 22 last month.
The offense falls under Section 376(1) of the Penal Code, which provides for a maximum penalty of 20 years in jail and whipping upon conviction.
Details of the Case
Based on the facts of the case, the incident occurred when the victim was asleep and woke up after realizing her body was being fondled, before the accused proceeded to commit the heinous act.
After the incident, the accused fled the house.
The victim lodged a police report at the Semporna District Police Headquarters (IPD) on September 27. A team from the Criminal Investigation Division (BSJ) of the Semporna IPD successfully arrested the accused on the same day.
Further investigation revealed that the accused was an adopted child who had been cared for by the victim’s family since he was 11 years old.
Prosecuting Officer Assistant Superintendent Jeffrey Kadisun did not offer bail, and the Court set November 24 as the date for mention of the case, pending the victim’s medical report.
