SIM Card Salesman Fined RM5,500 Over Red Paint Vandalism On Cars And House

Date:

A SIM card salesman was brought before the Magistrate’s Court here today after pleading guilty to two charges of splashing red paint on two vehicles and a house wall last month.

The accused, Chan Zhi Guang, 33, pleaded guilty to both charges, which were read out separately. He was subsequently fined RM3,500 and RM2,000 respectively by Magistrate Atifah Hazimah Wahab.

For the first charge, he was accused of committing mischief by splashing red paint on the windscreen and front bonnet of two Honda HR-V vehicles belonging to a 35-year-old man, causing losses amounting to RM2,200. The incident took place at a house in Eco Garden, Gelang Patah, at about 4.15am on March 26.

He was charged under Section 427 of the Penal Code, which carries a maximum jail term of five years, a fine, or both upon conviction.

For the second charge, he was accused of intentionally causing damage by splashing red paint at the front of a house belonging to a 36-year-old woman at a condominium along Jalan Cenderasari 2 at about 3am on March 22.

The offence falls under Section 426 of the Penal Code, which also carries a maximum penalty of five years’ imprisonment, a fine, or both.

Prosecuting officer Deputy Public Prosecutor Nik Noratini Nik Azman urged the court to impose an appropriate sentence as a deterrent.

In mitigation, the unrepresented accused appealed for a lower fine, stating that he earns RM2,500 a month and suffers from high blood pressure.

“I request for a reduced fine. I have already been fined RM3,500 earlier,” he said.

The court also ruled that he would face 12 months’ and four months’ jail respectively if he fails to pay the fines.
