Sabah Warns Unlicensed Tour Operators Of RM500,000 Fine, Jail Or Deportation

Tourists and operators found engaging in unlicensed tourism activities in Sabah will face strict enforcement action, including heavy fines, imprisonment, and deportation for foreigners, according to state authorities.

Assistant Tourism, Culture and Environment Minister Dr Andi Md Shamsureezal Mohd Sainal said such offences fall under Act 482, which is enforced by the federal government through the Ministry of Tourism, Arts and Culture (Motac).

He added that upon conviction, offenders may be fined up to RM500,000, jailed for up to 10 years, or face both penalties depending on the severity of the offence.

Foreign nationals involved in such activities may also face additional immigration action, including cancellation of passes, deportation, and blacklisting by relevant authorities.

Dr Andi was responding to a question from Tanjung Batu assemblyman Samuel Wong Tszun Chuen regarding enforcement against foreign tourists operating without licences and affecting local tourism operators.

He revealed that last year, 47 investigation papers were opened, resulting in RM290,000 in compounds issued. As of April 17 this year, 24 investigation papers have already been recorded, with RM86,000 in compounds issued, while several cases are still under investigation.

The state ministry, he said, has been working closely with Motac and other enforcement agencies to address the issue more effectively.

As part of proactive measures, the Sabah government has also established the Sabah State Tourist Safety Committee, which brings together multiple agencies including the police, Immigration Department, ESSCOM, and the Sabah Ports and Harbours Department.

Dr Andi stressed that these strict measures are necessary to safeguard legitimate local operators, ensure tourist safety, and maintain Sabah’s reputation as a sustainable and internationally respected tourism destination.
