A Magistrate’s Court here yesterday fined a supervisor RM6,500 after he was charged with reckless driving that caused the death of a motorcyclist last year.
Magistrate Arun Noval Dass imposed the sentence on the accused, Gue Kok Xin, 30, under an alternative charge pursuant to Section 43(1) of the Road Transport Act 1987, after considering submissions and mitigation from both parties.
The court also ordered the accused to serve eight months’ imprisonment in default of payment of the fine.
According to the charge, the father of one was accused of driving a lorry in a careless manner along Jalan Simpang Parit Lubok, Semerah, at about 8.15am on March 3 last year.
Section 43(1) of the Act carries a fine of up to RM10,000 or imprisonment of up to 12 months, or both, upon conviction.
Based on the facts of the case, police received a report of a road accident involving two vehicles which resulted in the death of a motorcyclist.
Investigations found that prior to the incident, the accused had driven his lorry out of a junction towards Kampung Parit Lubok. Upon reaching the location, the lorry was struck by a motorcycle, causing the victim to fall onto the road shoulder.
The motorcyclist died at the scene after sustaining severe head and bodily injuries.
Further investigations revealed that the accused admitted to driving recklessly, resulting in the death of the motorcyclist on the day of the incident.
The prosecution was conducted by Deputy Public Prosecutor Sharifah Natasha Syed Ahmad, while the accused was represented by lawyer Tan Song Yan from the National Legal Aid Foundation (YBGK).
