Father Faces 13 Charges Including Rape, Sodomy & Child Exploitation of 6-Year-Old Daughter

A 43-year-old school security guard of Malay descent has pleaded guilty to 13 charges involving sexual offences against his six-year-old daughter, including rape, oral sex, sodomy, producing sexual abuse videos, and performing sexual acts in front of the child. The case will return for sentencing on 4 March at the Johor Bahru court.

The child’s 46-year-old mother, also charged with neglecting her daughter, appeared in court separately. The girl is the non-marital child of the couple.

The father faced charges dating from 22 January to 17 February at their home in Kempas, including four counts of physical sexual abuse, four counts of non-physical sexual abuse, two counts of sodomy, two counts of producing sexual abuse videos, and one count of rape.

The four physical abuse charges relate to forcing the girl to perform oral sex, under Section 14(b) of the Sexual Offences Against Children Act 2017, punishable by up to 20 years’ imprisonment and whipping.

Four non-physical abuse charges, involving sexual acts committed in the child’s presence, fall under Section 15(c) of the same Act, carrying a maximum of 10 years’ imprisonment, fines up to RM20,000, or both.

The sodomy charges, under Section 377C of the Penal Code, could result in up to 30 years’ imprisonment and whipping if convicted.

Two charges of producing sexual abuse videos fall under Section 5 of the 2017 Act, punishable by up to 30 years in prison and six strokes of the cane.

The final charge, rape under Section 376(3) of the Penal Code (incest), carries a maximum of 30 years’ imprisonment and a minimum of 10 strokes of the cane.

The accused, unrepresented, confirmed he understood the charges and pleaded guilty through a court-appointed interpreter. Prosecutors requested that he be denied bail, which the judge approved.

Mother Charged With Neglect

The girl’s mother faces a charge of neglecting her daughter at the same residence, causing injury, under Section 31(1)(a) of the Child Act 2001. Conviction could result in a fine of up to RM50,000, imprisonment up to 20 years, or both.

She pleaded not guilty, explaining in mitigation that she earns RM30 daily as a restaurant assistant and must care for a seven-year-old son. The court allowed her bail at RM8,000, with monthly police reporting conditions.

The case is scheduled to continue on 2 April, with the mother required to appoint a lawyer and the prosecution set to submit relevant documents.
