Nepalese Worker Fined RM5,000 For Possessing Pornographic Video On Mobile Phone

A foreign worker was fined RM5,000 by the Magistrate’s Court after pleading guilty to possessing pornographic video content in his mobile phone.

The accused, Santosh Mukhiya, 24, a Nepalese national, entered his plea before Magistrate Nurhafiza Haron without legal representation.

According to the charge, Santosh was found in possession of obscene video recordings at about 11am on 26 April at a house in Parit Haji Ariff, Kayu Ara Pasong.

The offence falls under Section 292 of the Penal Code, which provides for a maximum penalty of three years’ imprisonment, a fine, or both upon conviction.

During mitigation, Santosh appealed for a lighter sentence, stating that he needed to support his parents and siblings back in Nepal.

The court imposed a fine of RM5,000, with an alternative of five months’ imprisonment if he failed to pay the amount. He subsequently settled the fine.
