Man Faces Sentencing After Admitting Sexual Offence Against Child

A security guard who pleaded guilty to sexually assaulting a minor will be sentenced by the Sessions Court here on June 11.

Judge Amir Shah Amir Hassan postponed sentencing proceedings after the prosecution requested additional time to finalise the facts of the case.

Deputy Public Prosecutor Nurul Shafeerah Mad Iskim informed the court that the case facts were not yet ready to be presented.

The accused, Mohd Firdaus Basir, 34, admitted to hugging an 11-year-old girl and kissing her on the cheek for sexual purposes at a compound near a kindergarten in Tuaran at about 5.50am on Jan 13.

He was charged under Section 14(a) of the Sexual Offences Against Children Act 2017, read together with Section 16(1) of the same Act.

The offence carries a maximum prison sentence of 20 years and whipping under Section 14(a), while Section 16(1) provides for imprisonment of up to five years and whipping upon conviction.

During mitigation, Mohd Firdaus, who was unrepresented, appealed for leniency, telling the court that everyone makes mistakes and urging that a heavier punishment not be imposed.

The judge reminded the accused that the court considers all circumstances before delivering a sentence and explained that mitigation is part of the judicial process.

Mohd Firdaus will remain in custody pending sentencing on June 11.
