A 26-year-old lorry attendant has been sentenced to 12 months in prison after pleading guilty to peeping at his 12-year-old stepdaughter while she was showering.
Magistrate Mustakim Sukarno imposed the sentence today after considering the accused’s guilty plea, as well as submissions and mitigation from both sides.
“The court also has to take into account the relationship between the accused and the victim before imposing the one-year prison sentence, effective from the date of his arrest on Sept 10,” he said.
The accused, who has three children, was charged under Section 509 of the Penal Code with insulting the modesty of his stepdaughter by peeping at her while she was bathing in a bathroom.
The offence took place at a house in the district at about 6.40am on Sept 9.
According to the facts of the case, the victim’s mother was at home when she noticed the accused looking at her daughter while she was showering through a gap around a pipe.
The woman confronted him after discovering what he was doing and questioned him about his actions.
The complainant also told police that a similar incident had allegedly occurred involving the girl in late July last year.
Police subsequently launched an investigation and arrested the accused at about 5.47pm the following day.
Section 509 of the Penal Code carries a maximum sentence of five years’ imprisonment, a fine, or both upon conviction.
Deputy Public Prosecutor Nur Shahzleen Ibrahim appeared for the prosecution, while the accused was represented by lawyer Heng Eng Gee from the National Legal Aid Foundation.
