A company director was fined RM10,000 by the Magistrate’s Court today after pleading guilty to making a death threat against a female lawyer last month.
Magistrate Nadratun Naim Mohd Saidi handed down the sentence to Heng Hua Kian, 45, and ruled that he would face 10 months in jail if he failed to pay the fine.
According to the charge, Heng criminally intimidated the 36-year-old victim by sending a message threatening to kill her, with the intent to cause fear.
The father of three committed the offence at Home Taste, Lebuh Macallum, at 5:33 p.m. on September 29.
He was charged under Section 506 of the Penal Code, which carries a maximum sentence of seven years in prison, a fine, or both upon conviction.
Deputy Public Prosecutor Ahmad Danial Amir Saad urged the court to impose a deterrent sentence, emphasizing the serious nature of the threat and the trauma caused to the victim.
However, the defense lawyer, Koay Chun Hian, pleaded for a minimum fine, explaining that his client was the sole breadwinner of his family, caring for his parents and three school-going children.
“My client is currently going through a divorce and under psychiatric treatment, suffering from severe emotional stress at the time of the incident. His guilty plea has also saved the court’s time and resources. He has since apologized to the victim for the trauma caused,” Koay told the court.
It is understood that the victim is the lawyer representing Heng’s estranged wife in their ongoing divorce proceedings.
